On March the 13th the Children and Families Bill received a Royal Assent. This Act introduces major changes to the special educational needs system in England which will now be enforced in September of this year. This Act aims to transform the existing Bill by putting families at the heart of the decision making process. The Act also sets out guidelines for education, health and care services that they all should be adhering to in order to provide children with coordinated support across the various areas of a children’s life, including school.

The Act will also run from birth up to the age of 25, instead of the current ruling of ending when a child leaves school.

The Act will include the independent specialist schools and indeed specialist colleges in the list of providers which can be named in an Education Health and Care Plan (EHCP). This will ensure that children with complex health needs are able to request placements at specialist schools.

This Act has been long overdue with the Chief Executive of The National Autistic Society, Mark Lever saying: “Just one in four young people with autism access any form of education and training after school so it is particularly encouraging to see the extension of statutory provision to the age of 25. This should help ease the transition from school to adulthood and help young people to access the support they need to reach their full potential.”
